General conditions of Sale

These general conditions of sale (the “General Conditions”) exclusively regulate the sale of goods (the “Products”) offered by Progetto Moda Srl (hereinafter for brevity “PM”) through the website www.anteprimaextra.com (“the Site”).

All contracts for the sale of Products by PM to any person making remote purchases through the Site, hereinafter referred to as the "Customer," are governed by these General Conditions, which form an integral and substantial part of every proposal, order, and order confirmation for the purchase of the Products. These conditions may be subject to change by PM from time to time. The general conditions published on the date of the order are considered valid and applicable to each individual order. It is therefore the Customer's responsibility to review these conditions on the date of their acceptance to verify their current and applicable content. 

These general conditions govern distance purchases, in accordance with Articles 50 et seq. of Legislative Decree no. 206 of 6 September 2005, Consumer Code, Section II of Chapter I of Title III of Part Three, to which reference is made as required by Article 60 of the Consumer Code, and in accordance with Legislative Decree no. 70 of 9 April 2003 on electronic commerce. These conditions are also inspired by the provisions of Directive 2011/83/EU of 5 October 2011, complying with it insofar as it contains provisions that are more favorable to the Customer-Consumer than the internal regulations, where derogable.

1. METHODS AND TIME OF CONCLUSION OF THE CONTRACT

With these general conditions of sale, PM sells and the Customer purchases remotely the Products listed and offered for sale on the website www.anteprimaextra.com. The contract is concluded exclusively online, through the Customer's access to the Website and the placing of a purchase order according to the procedure provided by the Website itself, and upon confirmation of the order.

The order for Products placed and correctly completed by the Customer constitutes a contractual proposal. The sale will be considered concluded when PM sends the Customer an order confirmation via email to the address indicated by the Customer when placing the order or when registering as a user. The email contains the Customer's and order details, the price of the purchased goods, shipping costs, and the shipping address to which the goods will be sent. The Customer undertakes to verify the accuracy of the information contained therein and to promptly communicate any corrections. Corrections to the data received by PM after the Products have been shipped and the invoice has been issued cannot be accepted.

PM reserves the right not to confirm the purchase proposal received with the order, for example due to a problem with the supply of Products, or inconsistencies or critical issues regarding the content of the order received. It also reserves the right to make the order confirmation conditional upon the receipt of additional information and/or clarifications from the Customer, by making a specific request to the Customer via email. 

2. THE PRODUCTS

For each product on the site, images of each color variant are available and in the window "Details" the description of the details and composition, as well as the table for choosing the size.

For further information, such as clarifications on the product's fit or measurements or individual sizes, the Customer is offered a customer support service, accessible from the "Ask" window within the product sheet.

PM strives to describe and present the products offered with completeness, fidelity to the original, and accuracy, providing as much detail as possible regarding the product's technical and aesthetic characteristics, details, and quality. However, some errors, inaccuracies, or differences between the virtual presentation and the actual product may occur, for which PM declines all responsibility. 

The product photographs published on the web pages describing the items do not constitute a contractual element, as they are only representative and indicative.

The technical and functional characteristics of the Products published by PM through its information messages on the product description pages are those communicated by the respective manufacturers. PM declines all responsibility for the accuracy and completeness of this information.

Products are not provided for testing. Although PM operators can provide information on Product characteristics, the Customer is responsible for choosing the Products ordered and ensuring they meet their needs.

3. PRICES

Unless otherwise indicated, the prices of the Products published on the Site are expressed in Euros and are inclusive of VAT.

To assist Customers who use a currency other than the Euro, the Site may in some cases indicate, in addition to the Euro amount, the price in the currencies most commonly used for international transactions (such as Sterling). This conversion is purely indicative. The amount charged to the Customer's credit card or PayPal account may vary, as it is based on floating exchange rates and bank fees in effect at the time of purchase.

It is therefore the responsibility of Customers who commonly use currencies other than the Euro to contact their bank to request detailed information on exchange rates and bank commissions relating to the Euro transaction of the order confirmed or that they intend to confirm on the Site.

The Customer accepts PM's right to change prices at any time. Product prices published on the site from time to time cancel and replace previous prices and are subject to actual Product availability.

The price guaranteed to the Customer is the one published on the Site at the time the Customer completes the order. The price set at the time of purchase is fixed and final and is unaffected by any subsequent price changes.

4. SHIPPING COSTS

Shipping costs are not included in the price shown on the product page, but are indicated and calculated at the end of the purchase process before order confirmation and payment. 

Customers can consult the "Shipping" page for shipping times. Shipping costs are also calculated based on the geographic destination and will be added when placing the order. 

Any import taxes and customs duties are not included in the price shown on the product sheet.

5. PRODUCT AVAILABILITY

Product availability indicated by size and color variant in the relevant product information refers to the availability at the time the customer consults the product information. However, this availability should be considered purely indicative because, during the hours of completing the purchase, the products may be sold to others before the order is confirmed. Products placed in your cart are not considered reserved and/or optioned and may therefore be purchased by other customers until the order is completed.

Even after PM sends the order confirmation email, there may be cases where the ordered products are unavailable. In this case, the Customer will be promptly informed via email of the detected unavailability and of any expected delivery times for the missing Product. The Customer will have the option of waiting for the indicated delivery times or canceling the order. They will communicate their decision via email and will receive a credit for the amount paid.

6. PAYMENT

Payment is due upon completion of the order process, which occurs when the Customer, having selected one or more products and entered their details and payment method, clicks on the "Log in and purchase" option (for registered users) or "Register and purchase" if you are a new customer.

Each payment by the Customer may only be made using one of the credit cards indicated on the Site (available for consultation here) or via Paypal. 

6.1. Payment by credit card 

At the time of purchase, Customers enter their credit card details into a secure electronic banking system provided by Moneta Web. More information on this system can be found at this link. link.

Communications relating to the payment and the data communicated by the Customer when this is made take place on specially protected lines and with all the guarantees ensured by the use of security protocols provided by the payment circuits.

To ensure greater protection for purchases made, PM recommends its customers sign up for the Verified By Visa or Mastercard Securecode services, requiring a PIN security code to make their purchases in complete safety.

6.2. Payment via PayPal

By choosing PayPal as the payment method, the customer can pay directly through their PayPal account. In this case, PM reserves the right to ship the goods only to the address indicated on the verified PayPal account, regardless of any different shipping address the customer may provide.

6.3. First purchases - New customers

With reference to orders confirmed by Customers making a purchase on the Site for the first time (hereinafter also referred to as "New Customers"), PM reserves the right to ask its bank or PayPal to verify the transaction, including by contacting the counterparty bank, before proceeding with the execution of the order. PM also reserves the right to request that new Customers ship the goods to the billing address, regardless of the different shipping address indicated by the Customer, and to make the confirmation and execution of the order conditional on the Customer's availability.

By completing the order, the Customer guarantees PM that he/she has the necessary authorizations to use the card or PayPal payment method and that he/she has the necessary funds on his/her card or PayPal account for the successful completion of the transaction.

Once the transaction confirmation has been received, PM will process the order and ship the purchased product.

7. ISSUANCE AND TRANSMISSION OF THE INVOICE

For each order placed, Anteprima – Progetto Moda Srl issues a standard commercial document (receipt) upon receipt of payment.

This document is generated internally and is not automatically sent to the customer. If you wish to receive a copy of the receipt or a tax invoice, the request must be made at the time of ordering or by email to assistenza@anteprimaextra.com before shipping the goods.

Once the order has been shipped and the tax document has been issued, it will no longer be possible to request changes to the data or to issue invoices on receipts already issued.

8. ORDER EXECUTION

8.1. Shipping 

The order will be executed within the timeframes and at the costs specified on the Site under the heading "Shipping".

In any case, PM undertakes to deliver the goods within 10 days from the day following the order confirmation.

This does not apply to New Customers, as defined in section 6.3 above. In this case, despite receiving the order confirmation, PM reserves the right to request confirmation from the customer's bank regarding the payment order and to process the order only after confirmation of the transaction's reliability. In this case, the 10-day period referred to in the previous section begins from the date of receipt of the confirmation from the counterparty bank.

Shipping times are always indicated in working days.

Orders are shipped by Progetto Moda Srl, Altamura, Monday through Friday, 9:30 AM to 18:00 PM. Orders confirmed on Friday afternoon, Saturday, and Sunday will be processed on Monday morning. Holidays and long weekends are always excluded from the count.

The products will be delivered via qualified express courier to the address indicated by the Customer at the time of the order.

Shipments will be made after receiving confirmation of the transaction from the circuit (credit card or Paypal).

Shipments to the Customer are insured free of charge against theft and accidental damage. The insurance ends when the shipment is completed. Delivery is considered completed when the Product is delivered to the Customer's address and collected by the Customer or a person authorized by the Customer.

The delivery document issued by the carrier, dated and signed by the Customer (or his Delegate) upon delivery of the Product, will constitute proof of transport and release of the goods.

8.2. Delivery to the Customer

a) Check the condition of the package being delivered

Upon delivery of the package, PM recommends that the Customer check the condition of the delivered Products before signing the acknowledgement of receipt, and in particular:

– that the number of packages delivered corresponds to that indicated in the transport document attached to the shipment;

– that the packaging is intact, not damaged, not wet or in any way altered and that the adhesive tape with the continuous ANTEPRIMA logo is placed around the package, without signs of tampering, cutting or breaking.

If the Customer finds any anomalies regarding the integrity of the delivered packaging, he or she has the obligation to refuse delivery of the products or to state his or her reservations in writing, detailed and dated, communicating to PM within three days of the refusal of delivery or the withdrawal with reservations.
If the forwarder's document is signed without adding any "reservations", the Customer will not be able to raise any objections regarding the external characteristics of the goods delivered.

b) Verification of the integrity and correctness of the delivered Product

Once the external integrity of the package has been verified, if, while checking the contents of the delivered package (i.e., the Products), the Customer finds any anomaly regarding, for example, the physical integrity of the Products and/or the correspondence or completeness of the Products received with respect to those ordered and confirmed, he/she must notify PM within 3 (three) days of delivery.

c) Delivery of products in the event of the customer's absence

If the recipient is absent during delivery, the carrier will leave a notice at the delivery address indicated by the Customer. The Products must be collected at the address and according to the methods indicated by the carrier. If the Products are not collected within the timeframe established by the carrier, they will be returned to PM, which reserves the right to refund the price of the Products, deducting the return shipping costs and any customs duties, which are the responsibility of the Customer who did not collect the goods. In any case, the Customer is responsible for any storage costs of the package until it is collected from the carrier or until it is returned to the sender.

d) Failure to perform due to causes attributable to the customer

By confirming the order, the Customer undertakes to do everything necessary and useful to enable the delivery of the Products by the carrier and to accept such delivery. If the package is not delivered for reasons attributable to the customer (for example: incorrect address, recipient consistently absent, incorrect telephone number, etc.), or if the customer refuses delivery, shipping costs and any customs fees will be deducted from the refund due to the customer.

e) Failure to execute the order due to force majeure

PM declines all responsibility for delays and/or disruptions attributable to force majeure or unforeseeable circumstances, including those resulting from internet malfunctions or disruptions, in the event that it is unable to fulfill the order within the timeframes set forth in these General Conditions and the details contained in the order confirmation.

In addition to those normally considered by case law, the following cases are explicitly considered as cases of force majeure:

– total or partial strikes, internal or external to the company, blockages of means of transport or supplies for any reason, government or legal restrictions, computer failures, blockages of telecommunications including networks and in particular the Internet.

If after a period of 3 (three) months the parties note the persistence of the case of force majeure, the order will be automatically cancelled, unless otherwise agreed between the parties.

9. RIGHT OF WITHDRAWAL

9.1. Appointments

The Customer, if classified as a "Consumer" under applicable law, has the right to withdraw from the purchase without penalty and without specifying the reason. PM sets a 14-day withdrawal period (longer than the minimum prescribed by the Consumer Code). This period begins from the date of delivery of the Products to the Customer's address.

9.2. Mode

To exercise this right, the Customer must send PM within the timeframe indicated in the previous point a written declaration to this effect, indicating: 1) the purchase order number; 2) the invoice number; 3) the Customer's name; 4) the Customer's email address; 5) the CUSTOMER's telephone number (optional field); 6) the code, description, and brand of the Product to be returned, specifying the quantity if greater than one unit; 7) any additional notes (optional field).
The return declaration can be sent, indifferently and alternatively, a) by email to the address info@anteprimaextra.com; b) by fax to (+39) 080 311 8444; c) by registered letter with acknowledgement of receipt to Progetto Moda Srl Piazza Zanardelli, 11, 70022, Altamura (BA).
Once the return declaration has been received, PM will promptly communicate to the customer the unique return code that the customer will use to return the product by delivering it to the carrier indicated by PM, with instructions for delivering the Product to the carrier.
The product must be returned to PM within 14 days of receiving the return code. For the purposes of this deadline, the product is considered returned when it is delivered to the carrier indicated by PM.

The substantial integrity of the item is an essential condition for exercising the right of withdrawal. The original Anteprima label must be attached to the item and must not be removed under any circumstances, nor must the seal to which the label is attached.
The label and all identifying stickers must not be cut or torn. Garments must not have been worn (but at least tried on without removing labels and stickers), washed, or altered, and must not show any signs of use. Shoe soles must be in perfect condition and free of any marks.
Each item must be returned with all original labels, packaging, and accessories (boxes, bags, hangers, garment covers, etc.) received with the Product.
All footwear and accessories must be returned with their original box, which is considered an integral part of the product itself and must not have been damaged and/or altered in any way, nor used as the sole external packaging.
Swimwear and underwear (bikinis, briefs, boxers, etc.) must be tried on over your own underwear. Returns of these items will be refused and returned to the customer if the transparent hygiene label has been removed, or if the items show signs of use. The outer packaging must consist of the Anteprima box received by the customer, if not damaged and/or altered when opened, or another packaging box of similar strength and durability to the one received.

The Products must also be returned complete with the attached tax documentation.

9.3. Acceptance of returns

Once the package containing the Product referred to in the return declaration has been received within the timeframe indicated in the previous point 9.2, and its integrity has been verified as better described in the previous point 9.2, PM will refund the amount of the products subject to withdrawal as quickly as possible and in any case within a maximum of 30 days.

9.4. Return due to lack of conformity of the Product

In case of receipt of products that do not comply with the orders or are defective, the CUSTOMER must communicate this via email to PM (at the address info@anteprimaextra.com) by submitting a return request using the same form and method indicated in points 9.1 and 9.2 above, adding a description of the reported defect of conformity and/or quality to the "additional notes" section and specifying whether the item should be replaced or refunded. PM reserves the right to request photographic evidence from the Customer to verify the reported defect.
Upon the Customer's request, and after any further investigations through photographic evidence, PM will send the Customer a shipping authorization number and shipping instructions. PM reserves the right to verify the disputed non-conformity and, if confirmed, will ship replacement goods (where available) or issue a refund via credit to the card used for the purchase, depending on the Customer's preference.

During the withdrawal period (defined as the period between delivery of the Products to the Customer and delivery to the carrier, with the return authorization), the Customer is responsible for the Product as custodian. In the event of damage or destruction of the Product while in the Customer's custody, the Customer will forfeit the right of withdrawal.

The Customer may not avail himself of the right of withdrawal referred to in points 9.1 and 9.2 in the case of purchase of personalized and/or made-to-measure products.

10. PERSONAL INFORMATION

Computerized data processing, including the management of website users' email addresses, is carried out in accordance with legal provisions. The personal information requested from the Customer is essential for processing and forwarding orders, creating invoices, and any warranty agreements.

For this purpose, this information may be communicated to PM's contractual partners.

The Customer may object to such communication and, pursuant to the law, avail himself of the right to access, modify, rectify and delete data concerning him by contacting Progetto Moda Srl, P.zza Zanardelli 11, 70022 – Altamura (BA).
To prevent any attempted fraud, PM reserves the right to ask the Customer for proof of his/her identity and/or domicile and/or his/her authorization to use the indicated payment method, making order confirmation subject to the Customer's willingness to provide any requested evidence.

11. EFFECTIVENESS OF THE GENERAL CONDITIONS – NULLITY AND/OR PARTIAL INEFFECTIVENESS

These General Conditions consist of all the clauses that comprise them. If one or more provisions of these General Conditions of Sale are declared invalid and/or unenforceable by the competent judicial authority, the remaining provisions will remain in full force and effect.

12. APPLICABLE LAW AND JURISDICTION

These General Conditions are governed by Italian law.
Any dispute that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the Court of the Customer's place of residence or domicile, if located within the territory of the State and if the Customer, in the context of the purchase in question, qualifies as a "consumer" pursuant to applicable law.
In all other cases, any dispute arising from relationships governed in whole or in part by these General Conditions will be devolved to the exclusive jurisdiction of the Court of Bari.

Pursuant to and for the purposes of Articles 1341 and 1342 of the Civil Code, the Customer declares to have carefully read, understood and specifically accepted the following clauses of PM's General Conditions of Sale: 1-2-3-4-5-6-7-8-9-10-11.
